Payment is due prior to shipping of any goods and is not contingent on seller providing any documentation, invoices, or other paper work.
All merchandise is Mobile Photo Booth property until payment is made in full.
All electronics are meant to be powered by AC electricity. They are not meant to be battery powered. We do not guarantee that any battery will hold a charge, nor is holding a charge necessary since AC power is needed to run a photo booth.
No party hereto shall be liable to any other party for any special, indirect, incidental or consequential damages of any kind whatsoever. NOT WITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, IN NO EVENT SHALL MOBILE PHOTO BOOTH THEIR AFFILIATES OR ANY OF ITS OR THEIR TRUSTEES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR SUBCONTRACTORS BE LIABLE FOR EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES), LOSS OF BUSINESS, OVERNIGHT OR RUSH FEES, OR LOST PROFITS, EACH OF WHICH IS HEREBY EXCLUDED BY AGREEMENT OF THE PARTIES REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER A PARTY OR ANY ENTITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
No returns will be accepted on special orders, or custom fabrication. Since colors can vary from their representation on the Web site due to monitor settings, you may wish to order a plastic sample for review for custom photo-booth panels.
Defective products will be replaced or repaired at our discretion. Battery state of charge is not a valid return reason.
All defective products must be returned to us within 07 days from the purchase date.
No returns accepted without a Return Merchandise Authorization Number (RMA#) from our customer service/sales departments. Please call your salesperson. Please provide the following information: Purchaser Name, Invoice Number and/or Order Number, Date of Invoice ,Nature of Problem, Original Packing List or Invoice.
Photo Booths must be collected at Mobile Photo Booth’s premises.
No Refunds will be accepted.
Mobile Photo Booth requires a 60% non-refundable deposit upon receiving the initial order and the balance must be paid in full and reflect in Mobile Photo Booth account on the collection date.
Some of the individual components of the Goods sold by the Supplier come with a manufacturer’s guarantee. For details of the applicable terms and conditions, please refer to the manufacturer’s guarantee provided with the Goods.
Any samples, drawings, descriptive matter, or advertising produced by the Supplier and any descriptions or illustrations contained in the Supplier’s catalogues or brochures are produced for the sole purpose of giving an approximate idea of the Goods described in them. They shall not form part of the Contract or have any contractual force.
Any quotation for the Goods given by the Supplier shall not constitute an offer. A quotation shall only be valid for a period of 20 Business Days from its date of issue.
The Goods are described in the Supplier’s website or in the Specification, as applicable.
The Customer shall indemnify the Supplier against all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by the Supplier in connection with any claim made against the Supplier for actual or alleged infringement of a third party’s intellectual property rights arising out of or in connection with the Supplier’s use of any Specification provided by the Customer. This clause shall survive termination of the Contract.
The Supplier reserves the right to amend the specification of the Goods if required by any applicable statutory or regulatory requirements.
All software updates to newer versions will be for the owners own account.
